1. Introduction

  • These Terms & Conditions (“Terms”) govern all bookings, services, products, and experiences provided by Hinat Tours (“Company,” “we,” “us,” or “our”).
  • By accessing our website, submitting an inquiry, confirming a booking, or participating in any service provided by Hinat Tours, you (“Client,” “Traveler,” or “Guest”) agree to be legally bound by these Terms.
  • If you do not agree to these Terms, you must not proceed with booking or using our services.

2. Company Status

  • Hinat Tours is a licensed Saudi Arabian tour operator offering services such as:
    • Private and group tours
    • Guided cultural experiences
    • Transportation services
    • Accommodation arrangements
    • Event-based travel programs
    • Customized travel design services
  • We may act as:
    • Principal provider of certain services, and/or
    • Agent for third-party suppliers (including hotels, transport operators, activity providers, and event organizers).

3. Bookings & Confirmation

3.1 Booking Process

  • A booking request does not constitute confirmation.
  • A booking is confirmed only when:
    • Written confirmation is issued by Hinat Tours, and
    • Required payment (deposit or full amount) has been received.

3.2 Accuracy of Information

  • Clients are responsible for ensuring all personal information provided is accurate, including:
    • Full legal names
    • Passport details (if required)
    • Travel dates
    • Contact information
  • We are not responsible for costs arising from incorrect information provided by the Client.

4. Pricing & Payments

4.1 Currency

  • All prices are quoted in Saudi Riyals (SAR) unless otherwise stated.

4.2 VAT

  • Prices may be exclusive of VAT unless explicitly specified.
  • Applicable VAT will be added in accordance with Saudi regulations.

4.3 Payment Terms

  • Full payment may be required to secure bookings unless otherwise agreed in writing.
  • For customized journeys or group bookings:
    • A deposit may be required
    • Final balance deadlines will be communicated in writing
  • Failure to meet payment deadlines may result in cancellation without liability to Hinat Tours.

4.4 Payment Methods

  • Accepted payment methods may include:
    • Bank transfer
    • Credit/debit card
    • Approved digital payment platforms
  • Any bank charges, currency exchange fees, or transfer fees are the responsibility of the Client.

5. Cancellation by Client

  • Cancellation requests must be submitted in writing.

5.1 Transportation & Guided Tours

  • 48+ hours before service: No cancellation fee
  • 24–47 hours before service: 50% of total service cost
  • Less than 24 hours / same-day / no-show: 100% of total service cost

5.2 Activities & Experiences

  • 72+ hours before activity: No cancellation fee
  • 24–71 hours before activity: 50% of total activity cost
  • Less than 24 hours / same-day / no-show: 100% of total activity cost

5.3 Accommodation Services

  • 7+ days before check-in: No cancellation fee
  • 3–6 days before check-in: 50% of total accommodation cost
  • Less than 72 hours / early departure / no-show: 100% of total accommodation cost

5.4 Refund Timing

  • Approved refunds, if applicable, will be processed within 14–21 business days.

6. Amendments & Changes

6.1 Client-Initiated Changes

  • Requests to modify dates, times, or services:
    • Must be made in writing
    • Are subject to availability
    • May incur additional costs
  • Changes requested within cancellation penalty periods may be treated as cancellations.

6.2 Company-Initiated Changes

  • Hinat Tours reserves the right to make reasonable changes due to:
    • Operational requirements
    • Weather conditions
    • Safety concerns
    • Government directives
  • Where significant changes occur, we may offer:
    • A suitable alternative, or
    • A partial refund where appropriate

7. Cancellation by Hinat Tours

  • We reserve the right to cancel bookings due to:
    • Safety concerns
    • Insufficient participant numbers
    • Force majeure events
    • Non-payment
    • Client misconduct
  • Where cancellation is initiated by Hinat Tours (excluding force majeure or Client breach), a full or partial refund may be provided at our discretion.

8. Force Majeure

  • Hinat Tours shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to:
    • Natural disasters
    • Government restrictions
    • War or civil unrest
    • Pandemics or epidemics
    • Extreme weather
    • Transportation shutdowns
  • In such cases:
    • Services may be rescheduled where possible
    • Refund eligibility will be reviewed case-by-case
    • Compensation is not guaranteed

9. Travel Documents & Entry Requirements

  • Clients are solely responsible for:
    • Valid passports
    • Required visas
    • Entry permits
    • Health documentation
    • Compliance with Saudi laws
  • Hinat Tours is not liable for denied boarding, entry refusal, or travel disruption due to documentation issues.

10. Health & Fitness

  • Clients must:
    • Disclose relevant medical conditions
    • Assess their own physical capability for activities
    • Follow safety instructions provided by guides
  • We reserve the right to refuse participation in any activity deemed unsafe for the Client or others.
  • Participation in certain activities (e.g., hiking, desert excursions, adventure experiences) involves inherent risks.

11. Limitation of Liability

  • To the fullest extent permitted by law:
    • Hinat Tours is not liable for acts or omissions of third-party providers.
    • We are not responsible for loss, theft, or damage to personal belongings.
    • We are not liable for indirect or consequential losses, including missed flights or business losses.
  • Our total liability shall not exceed the amount paid by the Client for the affected service.
  • Nothing in these Terms excludes liability for death or personal injury caused by proven negligence where such exclusion is prohibited by law.

12. Client Conduct

  • We reserve the right to remove any Client from a tour or service without refund if their behavior:
    • Endangers others
    • Violates local laws
    • Disrupts operations
    • Shows disrespect toward culture or staff

13. Photography & Media

  • Unless expressly declined in writing, Hinat Tours may use photographs or video footage taken during experiences for:
    • Marketing
    • Social media
    • Promotional materials
  • Clients may request exclusion prior to the start of the service.

14. Intellectual Property

  • All website content, branding, itineraries, and materials remain the intellectual property of Hinat Tours and may not be reproduced without written permission.

15. Privacy

  • Client personal data is processed in accordance with our Privacy Policy.
  • We do not sell or rent personal information.

16. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the Kingdom of Saudi Arabia.
  • Any disputes arising shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia.

17. Severability

  • If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Acceptance

  • By confirming a booking or using our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
